Not sure where you're going with the title and presentation of this. Okay, you can photograph him without being seen, but to what purpose? He's not really doing anything interesting. Even if he were facing the camera a little bit, it would be an improvement. I do like the lighting however.
A good candid moment that suffers from unfortunate lighting conditions and a difficult background. The rather odd lighting on the background affects the subject negatively because of the background - the subject appears to be over lighted and thus washed out. While it does meet the challenge criteria as a candid moment, it lacks technical and artistic impact. The author might have done better to get closer into the subject and at a sharper angle to the left.
