If I use the the hue/saturations adjustment layer to de-saturate the entire image in the masters layer then changed it to the red layer and saturated it would it be legal in basic since I'm doing it the entire image?

edit-I need to stop typing from my phone! My title is stoopid! LOL

Yes I believe that is legal.
