In order to use the high pass filter for sharpening (which is what I would guess you are asking), you have to use a second photo layer and then use one of the blending modes other than normal. Both of these are still forbidden in basic.
If just using it alone, I would think it would be as an effects filter, so probably no.
But if you think you might be using it legally, you can always submit your photo (before and after) in a ticket for a multi-SC opinion. You should try to allow sufficient time to get a response, though, which can take 2-3 days (at least to get a few different SC members to examine the before/after and chime in with an opinion).
