Who would be the arbiter of what is considered frivolous? What metric would you use to decide if a lawsuit was frivolous? In the eyes of the defendant, every lawsuit would be "frivolous".
The problem is not with the lawyers and judges; it's the people on the juries who look at the facts and make ridiculous verdicts and awards. Juries are made up of ordinary citizens. If you want someone to blame, look around. If juries didn't make those ridiculous decisions, the lawyers and plaintiffs would not have incentive to bring those cases. |
