i think it depens if your creating more layers that have different blending modes, i beleive that in basic you cant put layers on different blending modes...
If you can accomplish it with what is legal (i.e. curves, USM, noise grain, etc) plus some forethought before you click the shutter it can certainly be done. In fact it's probably better you do it that way with the limitations than simply apply some filter you downloaded from a web site.

Ok thats what I was looking for so if I took a shot and used adjustment layers to add noise and contrast ect to get a grunge feel thats legal but an effect filter like dragnsier is not

I think this one has an extraordinary look considering the limitations of basic editing. It approaches hdr-grunge fusion. I guess it's just the combination of the focus and the tones, but wow. What a happy accident.
