This has not been discussed by SC as a group, but I've been exploring that filter a bit and here's my take:

Using the PS-supplied skies would never be legal, even in Extended Editing.
Inserting a sky from your own work would be legal in Extended Editing as long as it met the date restrictions.
The Sky Replacement filter would NOT be legal in Standard Editing, with the exception of a case where you choose to use the masking function of the filter to mask in a better-exposed sky from the same exposure sequence as your main image (think HDR).
