A recent decision in federal courts in Virginia have the potential to limit a Photographer's right to claim infringement by allowing an excessively broad definition of fair use.

IMHO, it should have ended there.

I watched this story that involved a company stealing a photo, printing it on cell phone cases, outright selling them in major dept stores and profiting from them. If you watch the whole thing, you'll see why I said what I said above. They may have "won" their suit, but the real winners are ALWAYS the lawyers on both sides.

This is aside from whether or not I think the court's decision was right. I skimmed through the article (which is obviously biased against the decision) and tend to agree with the ruling. Sorry I don't have much time to go into great detail or debate right now, but maybe later.

If I haven't learned anything else in this business/hobby/calling/obsession/game it's that if you absolutely do not want an image ripped off, do not, DO NOT, DO NOT put it on the friggin' Internet.

Even if you win a case that comes from it, you still will in no way be appropriately compensated for the time and aggravation it will cost you.

The general populace has no clue and people who know better don't care.

Yah, it's wrong, how could they, yadda, yadda, but it's a plain fact.
