Several years ago, I took this shot in Saginaw, Michigan.
A couple of weeks ago, we went into our local Applebees and I found this by the desk where the greeter works.
We had dinner and then I asked to see the manager. I explained that the picture was mine and nobody had contacted me regarding the use of it. He told me that Applebees purchases their pictures in packages and that is done through the corporate center and he has no idea where it came from. He gave me the phone number of the corporate center in Flint, Michigan.
I called the corporate center and explained the situation and he said they buy these pictures from a company and they were all supposedly checked out and legal. He said he would do some research and give me a call back.
I received a call from him this morning and he told me that the company they buy them from has been fired by Applebees and went out of business. Whether that is true or not, I don't know. I told him that I'm not trying to screw anybody but I should be compensated for the image and he agreed. He asked me if I would be willing to work it out in gift certificates so I told him yes. We agreed on an amount and he is sending it out today.
if you can, it might be worth it to investigate further to find out more about this 'fired, out-of-business' company. even if they are no longer in business, chances are their assets (ie, image bank) is still in play, probably in the hands of any one of a number of former principals and/or employees. no telling where else your image, as well as others' images, may be showing up, unlicensed and uncompensated...
I don't like either one. But if Carnitas' Snack Shack ever uses one of my pictures, I'm all over it....
If EL INDIO uses my picture, I'll come back to San Diego just to consume my compensation. I used to live literally around the corner there, my first apartment, and I grew up with their business. Gawd, I miss El Indio.

Yes, El Indio is good, but I'm considering taking a job outside of San Diego, and I'm not sure whether it's more important to have a job, or to live within walking distance of the pig shack. There are no carnitas tacos like these. There could never be....
