i have a picture that looks better when several people are cloned out. they are all very small and far in the distance, and the photo is not of a person. Is this legal in adv editing?

I think it's going to depend on their relative size in the photo. I could look and give you my opinion, but your best bet is to check with the site council - pre-validate and/or see what they say in this thread.
In the future, do what I do and eliminate the people before you snap the pic. Just make sure you eliminate any witnesses as well.
It's a very dangerous thing, to clone people out of a scene. Curiously, the more people there are IN the scene, the more likely it is you could clone a few of 'em out. But if that scene were, say, a fabulous ocean sunset and the people are on the beach in the foreground, I think you'd be asking for trouble if you eliminated them. That's just my opinion, of course.
As I understand the rules, you can not change an image to the point where it would change the description of the image that the average viewer would give. I would describe those two images as being quite different. If that same amount of space that the disappeared people were in, were rocks up on the cliff face that had funky vegetation and you wanted to clone rocks from elsewhere in the image, no worries; but people notice people. If you got rid of one person out of the group, no worries. But to go from a crowd to a single figure really changes the tone of the image. Of course that's why you want to do it, it looks much nicer that way.
