Yes, but if it's a duplicate layer at 100% opacity, with no masking or selections, the effect is the same, because all of the layers under it are invisible. When you flatten the layers, there's no merging going on. All the layers underneath the duplicate layer are just deleted. This technique is useful to remember what you did, or to be able to easily back out a change, but doesn't violate the spirit of basic editing. Anything done this way can also be done in a single layer.
Using history snapshots is essentially the same thing, if you're layer averse.
